These Terms of Service (“Terms”) govern your use of TapInFlow, an AI-powered audience interaction platform available at tapinflow.com (“the Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms are a contract between you and TapInFlow, an independent individual operator established in Spain (“TapInFlow”, “we”, “us”), who provides the Service. The operator’s full legal details are available on request at hello@tapinflow.com.
1. The Service
TapInFlow is an AI SaaS platform that enables hosts to create interactive sessions — real-time polls, surveys, and Q&A — powered by artificial intelligence. Participants join via a short code or QR code and respond from their devices. The Service generates questions, collects responses, and produces AI-driven insights and reports.
2. Accounts & Eligibility
You must be at least 16 years old to create an account or act as a host, and accounts are not available to anyone under 16 (see our Privacy Policy). If you use the Service on behalf of an organisation, you represent that you are authorised to accept these Terms on its behalf, and “you” refers to both you and that organisation.
You are responsible for maintaining the security of your credentials and for all activity under your account. You must provide accurate information and keep it up to date. As a host, you are solely responsible for your interactive sessions and for the participants you invite — including verifying that participants meet any minimum age, obtaining parental or school consent where participants are under 16, having a lawful basis for any personal data you collect from them, and providing the privacy notices your audience is entitled to. We reserve the right to suspend or terminate accounts that violate these Terms.
Participants who are minors may only use a session under the direction and authorisation of a parent, legal guardian, school or other authorised educational institution. Hosts are responsible for providing any required notices and obtaining any legally required authorisation before inviting minors. For users in the United States, TapInFlow is not intended for independent use by children under 13; a child under 13 may participate only where the session is provided by a school or another authorised organisation in an educational context and that organisation has obtained, or can provide, the legally required authorisation.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose.
- Upload content that is defamatory, obscene, or infringes on intellectual property rights.
- Attempt to gain unauthorized access to systems, accounts, or data.
- Interfere with or disrupt the Service through bots, scraping, or automated scripts.
- Collect personal data of other users without their consent.
- Resell, sublicense, or redistribute access to the Service without our written permission.
4. Payments
TapInFlow offers free usage (limited), one-time credit packs (Starter, Pro Pack), and recurring subscriptions (Monthly Pro, Yearly Pro).
All payments are processed by Paddle.com Market Ltd (“Paddle”), which acts as the Merchant of Record for all transactions. By making a purchase, you also agree to Paddle's Terms of Use. Paddle handles invoicing, sales tax, and VAT collection on our behalf.
Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. You can cancel at any time from your account settings or via the management link in your Paddle receipt; cancellation takes effect at the end of the current paid period and stops future renewals. See our Refund Policy for details.
If we change subscription prices, the new price applies from your next renewal, and we will give you reasonable advance notice by email so you can cancel before it takes effect. Nothing in these Terms removes any refund or other mandatory rights you have under the consumer protection laws of your country of residence.
5. Intellectual Property
The Service — including its design, code, and branding — is owned by TapInFlow and protected by applicable intellectual property laws. You retain ownership of content you create or upload. By using the Service, you grant us a limited, non-exclusive license to host, process, and display your content only as needed to provide, maintain, secure, and support the Service for you. We do not use your session content or participant responses to train any AI model. We send this content to third-party AI providers only to generate your questions, insights, and reports; those providers process it under their own terms (see the Privacy Policy).
6. AI-Generated Content
The Service uses artificial intelligence to generate questions, insights, and reports. AI outputs are provided on an “as is” basis and may contain inaccuracies or errors. You are solely responsible for reviewing and deciding how to use AI-generated content. TapInFlow does not guarantee the accuracy, completeness, or suitability of any AI output.
7. Service Changes and Availability
We may modify, suspend or discontinue parts of the Service for operational, security or legal reasons. Where a material change adversely affects a paid service, we will provide reasonable advance notice where practicable and offer any remedy required by applicable law, which may include a proportionate refund or service credit.
8. Termination
We may suspend or terminate your access if you violate these Terms. You can delete your account at any time from your account settings (Danger zone), or by emailing hello@tapinflow.com with the subject “Delete my account”. Deletion is reversible for 14 days using the recovery link sent in the farewell email; after the recovery period, your personal account data is permanently anonymised, and the sessions you created and their associated responses are deleted, subject to records that must be retained by law. The full process is described in Section 7.1 of our Privacy Policy.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 9, 10, and 11) will remain in effect.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by applicable law, TapInFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits our liability where it cannot be excluded or limited under applicable law. In particular, these limitations do not apply to liability for fraud or fraudulent misrepresentation, wilful misconduct, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. If you are a consumer, nothing in these Terms removes or limits the mandatory rights you have under the consumer protection laws of your country of residence in the EU/EEA — including, where applicable, the right to bring proceedings before the courts of that country.
12. Changes to These Terms
We may update these Terms from time to time. For material changes, we will give you reasonable advance notice by email to the address on your account (or by an in-product notice) before they take effect, and where the law requires it we will ask you to accept the updated Terms. Minor or non-material changes take effect when the revised Terms are posted here with an updated effective date. If you do not agree to a change, you may stop using the Service and close your account before it takes effect.
